Terms and Conditions

These terms regulate the relationship between START WORKS MARKETING S.A. DE C.V. "Our Next Trip" and anyone who uses the site ournexttrip.com.mx, consult our services or book an experience. They are organized as a glossary: each entry defines a term that appears in the relationship between the traveller and Our Next Trip, and within that definition live the conditions they apply. The use of the site involves the acceptance of all of the above, in accordance with articles 1792 and 1803 of the Federal Civil Code.

  1. Identification. START WORKS MARKETING S.A.   2. Experience. Any tourist service offered by Our Next Trip, either an activity of the catalogue published on the site or a custom-designed itinerary. It includes, in an enunciative way: gastronomic, cultural and adventure tours, transfers, reservations in restaurants, welfare activities, access to VIP priority sites and combinations of the above. Each experience of the catalogue describes its inclusion, exclusions and particular conditions on its product page.
  3. Custom quotation. Proposal for a itinerary drawn up by the tailor-made concierge of the traveller, based on the information it provided on its dates, interests, number of persons and budget. The contribution does not create any payment obligation until the traveller expressly approves it. The payment of a personalized quote is processed through the Personalized Experience section on the site, entering the folio or package name agreed with the concierge.
  4. Concierge. The person assigned by Our Next Trip to design, coordinate and accompany the traveller's experience. The concierge is the point of direct contact during the trip, available by chat or call to attend to changes, doubts or unforeseen situations in real time. Its role is as an active intermediary between the traveller and the suppliers, not as a direct performer of the services in destination.
  5. Use allowed. The ournexttrip.com.mx site is available exclusively to persons with legal capacity to hire them for legal purposes related to the consultation and recruitment of tourist experiences. It is prohibited to use the site for illegal or fraudulent activities; to copy, reproduce or distribute the content, images, texts or design of the site without written authorization of START WORKS MARKETING S.A. DE C.V.; to unauthorised use the brand Our Next Trip, its logo or any intellectual property element; and to enter malicious code or to try to access the site's systems or databases without authorization.
  6. Use of the site. Access to ournexttrip.com.mx and the sending of the contact form involve acceptance of these terms and the Privacy Policy of Our Next Trip. The site is available for persons with legal capacity to hire. Our Next Trip reserves the right to reject any application without the need to express cause. Disputes arising from the use of the site or services are subject to the jurisdiction of the competent courts of Mexico City, renouncing any other jurisdiction.
  7. Prices. All prices published in ournexttrip.com.mx are shown in national currency, Mexican pesos (MXN), and include the Value Added Tax (VAT) unless expressly indicated otherwise in a specific quote or product. The prices may vary by season, availability and policy of the suppliers; however, once the traveller completes the payment and receives its confirmation, Our Next Trip will respect the agreed price, except in cases of obvious catch errors (e.g., notoriously disproportionate or inconsistent amounts), in which case the traveller will be informed and offered the option to keep the experience at the right price or to cancel with full refund.
  8. Payment methods. Our Next Trip accepts payments by credit and debit cards issued by authorised financial institutions, as well as other electronic means indicated in ournexttrip.com.mx (e.g. certified payment walkways or other forms of digital payment). The availability of payment methods may vary according to the country of issue of the card, the bank or the conditions of the gateway. When making payment, the traveller declares to be the holder of the means of payment used or to be authorized to use it.
  9. VAT. All the prices published in the ournexttrip.com.mx catalogue include the Value Added Tax at 16%, in accordance with the VAT Act in force. The prices of personalized contributions shall include VAT and shall be specified in the proposal sent by the concierge. START WORKS MARKETING S.A. DE C.V. will issue the digital tax voucher for each operation.
  10. I pay. The site processes payments through an encrypted gateway. Our Next Trip does not store or have access to complete bank card data; such handling occurs entirely within the certified processor environment. Confirmation of payment activates the management of the reservation. The non-compliance with an agreed payment in a personalized quote makes no effect on the booking commitments made by Our Next Trip with suppliers.
  11. Minimum length. Our Next Trip requests that reservations be made at least 34 calendar days in advance of the date of the start of the experience. This period is necessary to ensure availability with suppliers. Applications with less time are met subject to what is possible at that time, and Our Next Trip will be explicit about what can and cannot guarantee within that reduced time.
  12. Special preferences. Information that the traveller can share when contacting or hiring: food allergies, accessibility requirements, dietary restrictions, levels of physical activity or other conditions relevant to the design of the experience. Our Next Trip uses this information to make specific decisions with suppliers. The accuracy of this information is the responsibility of the traveller; Our Next Trip cannot guarantee adaptations based on incomplete or unreported data.
  13. Confirmation. Upon completing the payment of a catalog experience or a personalized quote, Our Next Trip will send an electronic confirmation to the registered mail with the details of the operation: name of the experience, date, amount paid and booking folio. This confirmation is the proof of the transaction and is necessary for any subsequent management.
  14. Revocation. Under article 56 of the Federal Consumer Protection Act, in purchases made through electronic means the consumer has the right to revoke his consent within five working days of the date of the transaction, provided that the experience has not been executed or started. In order to exercise this right, the customer must give written notice to contacto@ournextrip.com.mx within the specified time limit.
  15. Suspension. Our Next Trip reserves the right to suspend or cancel access to the site and any current reservation when it is detected: fraudulent use of the site or payment methods; non-compliance with these terms; use of the service for illegal purposes or causing damage to third parties; or any conduct that Our Next Trip considers incompatible with the nature of the service. In such cases no refund is made if the default is attributable to the customer.
  16. Cancellation. The act of rescinding a confirmed reservation. The economic conditions that apply according to the time of the cancellation are fully described in the Our Next Trip Reimbursement Policy, which is an integral part of these terms.
  17. Supplier. Third independent who directly performs the services that make up an experience: restaurants, tour operators, transport companies, guides, cultural sites or others. Our Next Trip acts as coordinator and concierge, not as a direct performer. It selects its suppliers with criteria, but does not control external factors such as third-party operational decisions, capacity, schedules or conditions at destination. With changes by a supplier, Our Next Trip will notify the traveller and seek an equivalent alternative.
  18. Our Next Trip's responsibility. Our Next Trip acts as a designer, coordinator and concierge of experiences, and in many cases as an intermediary between the traveller and the providers who directly execute the services at destination. The responsibility for the material operation of the service (hours, tour performance, conditions of the establishment, among others) lies with the supplier, in accordance with its own policies. To the extent permitted by the applicable legislation, Our Next Trip will not be liable for indirect damage, loss of profits or loss of opportunities arising from the use of the site or services contracted. If a direct liability of Our Next Trip to the traveller is determined, it shall be limited, at the latest, to the amount actually paid for the specific experience in question, without prejudice to the non-derogable rights granted to the consumer under the Federal Consumer Protection Act.
  19. Intellectual property. The content of the site ournexttrip.com.mx, including texts, images, design, logos, commercial name Our Next Trip and software, is owned by START WORKS MARKETING S.A. DE C.V. or its licensors and is protected by Mexican intellectual property laws. No item can be reproduced, distributed or used without express and written authorization by START WORKS MARKETING S.A. DE C.V.
  20. Force majeure. Events outside the control of Our Next Trip that prevent the realization of an experience: extreme weather conditions, closure of sites by competent authority, security situations at destination or other unpredictable and irresistible events. In these cases Our Next Trip will offer reprogramming in the first instance. If it is not possible or the traveller does not accept it, reimbursement of the amount paid shall be processed less the unrecoverable costs already committed to suppliers, in writing detail.
  21. Final provisions. These terms and conditions constitute the full agreement between START WORKS MARKETING S.A. DE C.V. "Our Next Trip" and the traveller in relation to the use of ournexttrip.com.mx and the contracting of experiences through the site, replacing any prior understanding or agreement, verbal or written, on the same subjects. If any of the provisions contained here are declared null, void or inapplicable by a competent authority, that determination shall not affect the validity of the other provisions, which shall remain in full force. The fact that Our Next Trip does not exercise a right or does not require the performance of an obligation in a particular case should not be interpreted as a waiver of that right or obligation in the future.
